What evidence is most important for my slip & fall accident?

Return to FAQ Videos

Transcript:

The legislature has made it difficult to prove negligence with a slip & fall situation. The first thing to do is take photos of the substance that caused your fall, and fill out an incident report. The store needs to know that the fall happened, so you must report it. You must record the incident report, but be cautious about signing. Take notice to look up for security cameras for video evidence. Notify your attorney immediately, and mention the cameras that caught the fall. Get names and numbers of witnesses, to allow your attorney to do their due diligence. This may be the key to recover.

To support the incident report, have someone go buy something to prove that you were in the store at that time. A credit card statement can prove you were in the store at this time. This type of case requires evidence and leg work from the client to take these notes, and this opportunity. Don’t just take a photo of the area, but be thorough to include best angle to convince a jury. Ask the manager to hold onto store videos for our use. We will send our preservation letter to store.
