What is a slip & fall vs. a trip & fall?

Return to FAQ Videos

Transcript:

A trip & fall is easier to prove, such as an occasion where you go to step on something, and there’s a hole, or broken sidewalk. Be sure to take photos and make a report. If injured, go to the hospital because it serves as a record. Explain to the hospital what occurred with the slip & fall. The medical records can sometimes be used against our clients. In a trip & fall situation, it is important to take photos, taken horizontally to show a concrete gap, for example. In a slip & fall, you must show that the business had knowledge that a substance was on a floor, creating a hazard. It’s important to get witnesses. Taking a photo can help in proving how long the substance was on the floor. You might want to go back to the scene the next day and take a photo of the area, to help prove the negligence.

Take photos with a smart phone because there will be data stored with the photo to help show the condition with the case.
