The plaintiffs claim that they suffered severe burns when the cans of cooking spray erupted after being placed near a hot stove. In some cases, people said these explosions were so severe that they were disfigured and subsequently had to undergo surgeries and skin grafts.
Specifically, the lawsuits allege that the vented design of the limited edition can was defective and concurrently allege that Conagra failed to warn consumers about the potential explosion risks. On its part, Conagra has publicly stated that its products are safe and that the company is no longer producing the can design in question.
However, if it is later determined in a courtroom setting that the design was defective or that Conagra failed to properly warn consumers, the fact that this form of the product has been subsequently removed from the marketplace will not affect the liability this company would incur. Additionally, a spokeswoman for the Consumer Products Safety Commission has indicated that it is also researching the reports behind these lawsuits.
